Canary Patterns is an independent practice in learning design, consulting, and writing, operated by a sole proprietor in Washington State, USA. Products include digital downloads (such as field guides, prompt packs, and toolkits), consulting services, and a forthcoming web application (Thinking Forge). References to "the site" in these Terms refer to canarypatterns.com and any associated pages or services.
By using this site, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using the site on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Upon completing a purchase, you will receive access to the purchased digital product via a download link on the post-purchase confirmation page. You are responsible for downloading and saving your files promptly. We are not obligated to store your purchased files indefinitely or to re-deliver them at a later date, though we will make reasonable efforts to assist in the event of a technical delivery failure.

Consulting services (Training Audits, Training Design, Ongoing Advisory) are provided as described on the Products & Services page. Scope, deliverables, and timelines are agreed upon before work begins. Consulting fees are non-refundable once work has commenced unless otherwise agreed in writing.
All sales of digital products are final. Because digital products are delivered immediately upon purchase and cannot be "returned," we do not offer refunds as a matter of standard policy. If you experience a verified technical failure that prevents you from accessing your purchased product, contact us at hello@canarypatterns.com within 7 days of purchase.
All content on canarypatterns.com — including but not limited to text, design, graphics, frameworks, prompt structures, methodologies, branding, the Forge Method, and the Canary Patterns brand — is the intellectual property of Canary Patterns and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, copy, modify, or distribute any part of this site or its products without our prior written permission, except as expressly permitted under the license granted upon purchase.
Some Canary Patterns products are designed to be used with third-party AI tools, including ChatGPT (OpenAI) and Claude (Anthropic). Your use of those tools is subject to their respective terms of service. Canary Patterns is not affiliated with, endorsed by, or a partner of OpenAI or Anthropic. We make no warranties regarding the quality, accuracy, or suitability of outputs generated by AI tools. You are solely responsible for reviewing and validating any AI-generated content before using it in a professional context.
By using this site and its products, you agree not to violate any applicable law, infringe on intellectual property rights, resell or redistribute purchased products, reverse-engineer any framework or methodology for commercial purposes, use the site to transmit harmful code, attempt unauthorized access, use automated tools without permission, or impersonate Canary Patterns or its representatives.
To the fullest extent permitted by applicable law, Canary Patterns products, the site, and all content and services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our products will meet your specific needs, that the site will be uninterrupted or error-free, or that any AI-generated outputs will be accurate or appropriate for your use case.
To the fullest extent permitted by applicable law, Canary Patterns shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total cumulative liability shall not exceed the amount you paid to Canary Patterns in the twelve (12) months preceding the event giving rise to the claim, or $50 USD, whichever is greater.
You agree to defend, indemnify, and hold harmless Canary Patterns from and against any claims, damages, losses, liabilities, costs, and expenses arising out of your use of the site or its products, your violation of these Terms, or any AI-generated content you create using our products.
Before initiating any formal legal proceedings, you agree to contact us at hello@canarypatterns.com and give us 30 days to attempt to resolve the dispute informally. If informal resolution fails, disputes shall be resolved by binding individual arbitration in Washington State. You waive any right to participate in a class action.
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top. Your continued use of the site constitutes acceptance of the updated Terms.
